Yuba Water Agency directors were scheduled to consider continuing emergency contracting authority for repairs tied to the Colgate Penstock incident, with work still unfinished nearly eight months after the agency’s initial authorization.
The agency’s Oct. 20 board agenda says the Board authorized the general manager on Feb. 17, 2026, to use the agency’s emergency contracting actions in response to the incident. It says repair work remains in progress and staff recommends continuing that authority until the repairs are completed.
The item cites California Public Contract Code section 22050, which requires the Board to review an emergency contract action at each regular meeting until the contracted work is complete. Approval of the continuation required a four-fifths vote, according to the agenda.
The Oct. 20 document is a scheduled-action agenda, not a record of the meeting’s outcome. The materials reviewed do not establish whether directors approved the continuation. They also do not provide a verified cumulative cost for the incident response or a firm date for full restoration.
Yuba Water’s draft minutes from Sept. 15 show that directors previously received an update and presentation on the Colgate Penstock incident and considered the need to continue emergency action under the same statute. Those minutes do not provide a final repair schedule or a cumulative spending total.
The agency’s approved Oct. 20 minutes or meeting video would show the vote and any discussion. Contract records, change orders and payments would be needed to establish the total public cost of the response.
