The Live Oak City Council on Aug. 19 voted 3-1 to advance a broad rewrite of the city’s nuisance enforcement rules after public comment and council debate focused on how far the city can go onto private property and how it regulates curbside garbage cans.
Staff said the proposal would repeal and replace Live Oak Municipal Code Title 8, Chapter 8.24 and repeal Chapter 14, folding nuisance rules into a single updated framework with clearer definitions, notice procedures, appeal steps and enforcement tools. The staff report said the overhaul is intended to streamline nuisance enforcement and address blight.
During the hearing, council discussion centered on right-of-entry language and whether the ordinance went too far in regulating property owners. Public commenter Alan Deela objected to the garbage-can restriction. After the discussion, the council moved the ordinance forward with an amendment to Section 8.24.100(I) allowing garbage cans within 15 feet of the front yard line for a 12-hour period, according to the meeting summary.
Councilmember Nancy Santana voted no on the motion.
The ordinance had been presented as a full repeal-and-replace of the city’s nuisance code, with staff describing it as a way to consolidate enforcement and provide clearer legal authority for complaints, notices and appeals.
