Yuba City’s City Council unanimously appointed the only nominees for three council districts on Aug. 20 and canceled the Nov. 3 consolidated general election for those seats.
The council acted under Elections Code section 10229, which allows a local governing body to appoint a nominee when no more than one candidate is filed for an office. According to the city’s staff report, the nomination period closed with only one candidate in each of the three districts: Dave Shaw in District 1, Marc Boomgaarden in District 2 and Mike Pasquale in District 3.
The staff report said the city had already received certification from the registrar of voters confirming the uncontested races and laid out the council’s three options: appoint the nominees, direct that the election be held as scheduled, or take no action. It also said the city estimated election services for the three seats would cost $50,000-plus and that avoiding the election would likely produce savings.
At the meeting, the council appointed Shaw, Boomgaarden and Pasquale to their districts and adopted a resolution withdrawing the races from the November election, according to the council meeting record.
The council packet also said the city clerk had posted the required notice and that any appointed candidates would qualify and take office as if elected.
