Four residents asked the Humboldt County Planning Commission on Oct. 15 to schedule action on Miranda’s Rescue’s conditional-use permit, including a request to recommend revocation to the Board of Supervisors.
The requests came during the commission’s non-agenda public-comment period, which the county’s agenda said could not be acted on by the commission at that time. The agenda listed three Miranda’s Rescue-related attachments under public comment on non-agenda items; it did not list a permit-revocation hearing or other scheduled action on the rescue.
Jennifer Raymond asked the commission to agendize a recommendation to revoke the permit. Andrew Martinez also called for revocation and a new application process. Lori Mancell and Nancy Klein separately urged county action while raising allegations about permit compliance and county oversight. Those allegations were made by commenters and were not resolved during the meeting.
After public comment, Planning and Building Director John H. Ford said Miranda’s Rescue’s permit remained suspended, the same status he had reported at the previous meeting, according to the Oct. 15 meeting recording. The commission then moved to its consent agenda and a public hearing on the Humboldt Bay Area Plan. No revocation vote or referral was recorded in the available meeting record.
The issue also surfaced during non-agenda public comment at the commission’s Oct. 1 meeting. In that meeting, staff said the permit had been suspended after a compliance-agreement deadline and that a suspension could last up to 180 days, after which it would need to be lifted or scheduled for revocation. Staff also said the Planning Commission could recommend revocation to the Board of Supervisors but could not itself take revocation action. The Oct. 1 meeting recording contains that discussion.
The county’s detailed basis for the suspension, the complete permit and compliance file, and a response from Miranda’s Rescue were not available in the materials reviewed for this story.
